Toss a Bean Bag and Win Some CASH. Event created April 2017 Hey, you never know until you try. Official Rules, Terms and Conditions Entry fee ONLY $25 for 1 ticket and 1 toss, $50 for 2 tickets and 3 tosses, $100 for 4 tickets and 8 tosses. (Extra tosses are ONLY used in the First Elimination Round). ONLY 2000 tickets will be sold. You may enter as many times as you like until all 2000 tickets have been sold. (If over 2000 tickets have been sold, any ticket over 2000 will be refunded and not allowed to participate). One WINNER will get $10,000  One WINNER will get $1,000  One WINNER will get $200 and one of the corn-hole sets used in the tournament.  All proceeds are for entrepreneurship startup funding. AND a donation may be made to a local charity. I.D Must be presented at check in.  By purchasing a ticket you agree to the rules, terms and conditions. Must print legibly or you cannot be notified. ALL entrants will be notified after last entry is sold. If the ticket is not legible by two administrators, then that person(s) will be eliminated. ONLY the name on the ticket can toss for that ticket. If purchasing more than one ticket at a time, then (two tickets for $50 or four tickets for $100) the same name must be on all tickets or the person(s) will be eliminated from this event. You may buy tickets for other people and you may put their names on those tickets, however you CANNOT share tickets. Only ONE name per ticket will be allowed. All entrants will be assigned a number. Each entrants number will be the number on your ticket(s) allowing your name to remain private until the winner is announced, if administrators choose. You agree to have your name, prize, and picture(s) public for the purposes of producing a winner in this competition. If caught cheating, you will be eliminated. If you are purchasing an entry for a donation only, please write DONATION in the Name line and you will not be contacted. Please NOTE Donations are NOT tax deductible. We reserve the right to eliminate someone(s) from the competition at any time for any reason. Satellite locations may be used. All times and date(s) ARE tentative. If you bought a ticket and get eliminated no refunds will be given. If you are not available after three attempts, you will no longer be considered and you will NOT be given a refund and will be considered eliminated. If you do not show up during the time slot that you have chosen, you will be eliminated and no refund will be given. If you cannot come into the location set to toss a bag during date(s) set for the toss, then you will no longer be considered and will NOT be given a refund. NO REFUNDS for any reason will be given. Here is how the toss will work. The front edge of the corn hole platform will start at 27 feet to the toss line. This measurement was determined from the ACA - American Corn Hole Association (2009) and accepted by the administrators. In the event of a playoff, the 27-foot distance may be expanded. For each ticket purchased, that person will throw only ONE corn hole bag (the bags will be provided and or approved by the administrators) at a corn hole board (the corn hole board will be provided and or approved by administrators). ALL holes-in-one will be placed into next bracket. If no hole in one, then that person(s) will be eliminated and this game is over for that person(s). Only hole in ones with one bag and one toss will be moving on into the next bracket. (If extra tosses included they will be administered during the first elimination round ONLY). Bags will be cleared off the board after each toss. You will not be allowed to use your own bag or corn hole board. The administrators will approve the board(s) and bag(s) so that every person will have the same opportunity. The elimination brackets may be posted on www.kimsoil.com. If a playoff will need to be conducted after brackets have been played, more than one bag may be used and points will be calculated or the distance will be increased until there is one winner. If points are used, the most points will win. If distance is increased only the hole-in-one will continue until there is only one winner. The number of brackets and playoff(s) and whether distance or points may be used will be determined by the administrators. The Toss A Bag And WIN Some CASH will be at The Hammond, Indiana National Guard Armory located at 2530 173rd St. Hammond, Indiana 46323. ALL contestants will be notified after last ticket is sold and placed into brackets This skilled competition MAY be done over a series of days/weeks that will be scheduled with participants choosing from the time slots that are available at that time. ​​Round 1 will be the first elimination bracket where all 2000 ticket holders will participate. Some participants may have purchased more than 1 ticket that may include extra tosses for the FIRST elimination round ONLY). If you purchased $25 entry – it counts as 1 ticket and will get one toss. If you purchased $50 entry – it counts as 2 tickets and you will get three tosses in the first round, but only need 2 holes-in-one to move on with 2 tickets. Extra toss in the first round is only IF needed. If you purchased $100 entry – it counts as 4 tickets and you will get eight tosses in the first round, but only need 4 holes-in-one to move on with 4 tickets. Extra tosses in the first round is only IF needed. Every ticket counts as ONE entry to win.  If $50 is purchased by the same person using the same name, then that person will get three opportunities (tosses) to get TWO holes-in-one because $50 is considered ONLY two tickets, however, that person is given one EXTRA toss during the FIRST elimination bracket only if needed to try and get two holes-in-one. If that person gets two holes-in-one, then that person will get to move on with two tickets into the next elimination round where ONLY one toss per ticket will be used. THE EXTRA tosses are ONLY to be used during the FIRST elimination bracket/round.  If ONLY one hole-in-one is made, then that person will ONLY get one ticket to move forward with. If NO hole-in-one is made, then that person will be eliminated. If $100 is purchased by the same person using the same name, then that person will get eight opportunities (tosses) to get FOUR holes-in-one because $100 is considered ONLY four tickets, however, that person is given four EXTRA tosses during the FIRST elimination bracket only if needed to try and get four holes-in-one. If that person gets four holes-in-one, then that person will get to move on with four tickets into the next elimination round where ONLY one toss per ticket will be used. THE EXTRA tosses are ONLY to be used during the FIRST elimination bracket/round. If 4 holes-in-one is made, then 4 tickets will move forward If 3 holes-in-one is made, then 3 tickets will move forward If 2 holes-in-one is made, then 2 tickets will move forward If 1 hole-in-one is made, then 1 ticket will move forward If no hole-in-one is made, then that person(s) will be eliminated. THE EXTRA tosses are ONLY to be used during the FIRST elimination bracket/round. At no time can anyone change the name on any ticket, or that person(s) will be eliminated. If you do NOT understand all rules, terms and conditions DO NOT purchase a ticket(s). If you do not agree to all rules, terms and conditions DO NOT purchase a ticket(s). Eligibility: Toss A Bag and Win Some CASH (the “Competition”) is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years of age or the age of majority in their state of residence, whichever is older, as of the date of entry. Employees of Kims Oil LLC are not eligible. The Toss A Bag and Win Some CASH is subject to all applicable federal, state, and local laws and regulations and is void where prohibited. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s and Administrator’s decisions, which are final and binding in all matters related to the competition. Timing: The Competition begins as soon as the last of only 2000 tickets are sold. Central Time ("CT") and ends after there is only one person for each prize after all eliminations and possible play offs have been played where there is only one first place winner, one second place winner and one third place winner. Administrator’s computer is the official timekeeping device for the competition. 4. How to Enter: During the Promotion Period, visit www.kimsoil.com ("Promotion Website") and follow the link and instructions for completing and submitting your entry. Also tickets can be purchased in person by anyone who is promoting event. Cash and Credit cards will be accepted.   CREDIT CARDS ACCEPTED in person or at kimsoil.com Limit: Each entrant may receive as many tickets as purchased up to 2000 during the Promotion Period. Multiple participants are not permitted to share the same ticket. Any attempt by any participant to change names after purchase or adding names to other tickets or any other methods or not following the rules will void that participant's entries and that participant may be disqualified. Kims Oil llc, and any of their affiliates and administrators also identified as, “Released Parties”, are not responsible for lost, late, incomplete, invalid, unintelligible or misdirected registrations, which will be disqualified. In the event of a dispute as to any registration or play, the authorized account holder of the email address and or phone number used to register will be deemed to be the registrant or player. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winner may be required to show proof of being the authorized account holder. 5. Prize: Administrators decisions as to the administration and operation of the competition are final and binding in all matters related to the competition. Administrators will observe all potential competition winners from all eligible entries received during the Promotion Period, toss a bag. First place Prize is $10,000, Second place Prize is $1,000 and Third place Prize is $200 and one of the corn-hole sets used in the tournament.   The winner(s) will be awarded their Prize, as mentioned above. The winner(s) will be notified immediately at the competition. Except where prohibited, the Prize winner(s) will be required to sign and return a Declaration of Compliance, Liability and Publicity Release which must be received by Administrator, within seven (7) days of the date of notice or attempted notice is sent, in order to claim the prize. If the winner fails to sign and return the Declaration of Compliance, Liability and Publicity Release within the required time period, the winner forfeits the prize. Receiving a prize is contingent upon compliance with these Official Rules. If the prize is not claimed in 120 days from the date the winner(s) are announced the prizes will remain un-awarded. The Prize will be fulfilled by the designated administrator or representative of the event.  Winner is responsible for taxes, preparation costs or any other fees associated with prize(s).  Winner must take delivery of from administrator or representative. Winner must claim prize(s) and complete tax form(s) within 120 days of winning or prize(s) will be forfeited in its entirety. No refund or compensation will be made in the event of the cancellation or delay.  All expenses and incidental costs not expressly stated in the description above, taxes or other expenses are solely the responsibility of the winner. Restrictions, conditions, and limitations may apply. Administrator will not replace any lost, mutilated, or stolen tickets. The Released Parties are not responsible if in the event the tournament is delayed, extended, rescheduled, postponed, or cancelled for any reason, in which event that portion of prize(s) is forfeited in its entirety and no substitution will be provided except as in Administrator’s sole discretion. Tickets are subject to certain terms and conditions as specified by issuer. Prize winner(s) agrees that the prize awarded pursuant to a revocable, nontransferable license that is personal to the winner. Failure to do so may result in forfeiture of such portion(s) of prize. Prize(s) are non-transferable and no substitution will be made except as provided herein at the Administrator’s sole discretion. Administrator reserves the right to substitute the prize(s) or a prize component for one of equal or greater value if the designated prize should become unavailable for any reason. Winner is responsible for all taxes and fees associated with prize receipt and/or use, including but not limited to, all state, federal, and income taxes. Odds of winning the Prize depend on the number of eligible entries received during the Promotion Period.  ** If all 2000 tickets are not sold, administrator can choose to refund all tickets, continue competition or lower the prize amounts based on tickets purchased. 6. Release: By receipt of the prize(s), winner(s) agrees to release and hold harmless competition Entities, promotional partners, Kims Oil LLC, and each of their respective subsidiaries, affiliates, limited liability companies, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each of their respective officers, shareholders, directors, members, employees, licensors, successors, assigns and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the competition or receipt or use or misuse of any prize. 7. Publicity: Except where prohibited, participation in the competition constitutes winner’s consent to Sponsor’s, its agents’, and promotional partners’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration. 8. General Conditions: Administrator reserves the right to cancel, suspend and/or modify the competition, or any part of it and/or If any fraud, technical failures or any other factor beyond Administrator’s or Sponsor’s reasonable control impairs the integrity or proper functioning of the competition, as determined by Administrator in its sole discretion. Administrator reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the competition or to be acting in violation of the Official Rules, Rules, Terms or Conditions of this or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the competition may be a violation of criminal and civil law, and, should such an attempt be made, Administrator and Sponsor reserve the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's and/or Administrator’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. 9. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the competition; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in cellular networks, phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the competition; (4) technical or human error which may occur in the administration of the competition or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the competition or receipt or use or misuse of any prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the competition, if it is possible. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Administrator reserves the right to award only the stated number of prizes by a playoff among all legitimate, un-awarded, eligible ticket holders. 10. Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this competition or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court or the appropriate Indiana State Court. (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this competition, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and the Released Parties in connection with the competition, shall be governed by, and construed in accordance with, the laws of the State of Indiana without giving effect to any choice of law or conflict of law rules (whether of the State of Indiana or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Indiana. 11.
